I hereby acknowledge and agree to the terms of this Hold Harmless Agreement with Controlled Pair Concepts LLC, regarding my participation in firearms training conducted by Controlled Pair Concepts LLC.
1. Assumption of Risk: I understand that participation in training involves inherent risks, including but not limited to the use of firearms, exposure to loud noises, and physical activity. I voluntarily assume all risks associated with the training, including any risks that may arise from the negligence or carelessness of Controlled Pair Concepts LLC, its employees, instructors, or agents.
2. Release and Waiver: In consideration for being allowed to participate in training, I, on behalf of myself, my heirs, representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Controlled Pair Concepts LLC, its directors, officers, employees, instructors, agents, and any other individuals involved in training (collectively referred to as "Released Parties"), from any and all liability, claims, demands, actions, causes of action, costs, and expenses, including but not limited to attorney fees, arising out of or related to any loss, damage, injury, or death that may be sustained by me or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in training.
3. Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, liabilities, costs, and expenses, including reasonable attorney fees, arising out of or related to my participation in training, including but not limited to any claims brought by third parties, whether caused by the negligence of the Released Parties or otherwise.
4. Insurance: I understand that Controlled Pair Concepts LLC may carry general liability insurance, but this insurance may not cover any claims arising from my participation in training. I am solely responsible for obtaining any additional insurance coverage that I deem necessary.
5. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the Florida without regard to its conflict of laws principles. Any dispute arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Florida.
6. Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
By signing below, I acknowledge that I have read and fully understand this Hold Harmless Agreement and voluntarily agree to be bound by its terms.
